The City Council of the City of Taylor met on February 6, 2006, at City Hall, 400 Porter St., Taylor, Texas.  Mayor Donald Hill declared a quorum and called the special meeting to order at 6:00 p.m. with the following present:

 

Council Member Benito Gonzales                      City Manager, Frank Salvato

Council Member Rod Hortenstine                      City Clerk, Susan Brock

Council Member Ella Jez                                     City Attorney, Ted Hejl

 

REGULAR AGENDA – REVIEW/DISCUSS & CONSIDER/ACTION:

CONSIDER RELOCATION OF WASTEWATER LINE RELATED TO MALLARD PARK PHASE II OFF SITE DRAINAGE.
Mr. Salvato presented a request from the Mallard Park developer Mr. John Biggar to reconsider changes to the off site drainage work previously addressed by Council.  Since the original plan was derived, additional costs have surfaced related to the cost of relocating the existing waste water line due to changes in the engineering design drawings.  Mr. Biggar is requesting that the City proceed with recording the plat with no additional requirement of bond funds from him.  Mr. Hejl’s recommendation to Council is to require a performance bond with regards all work yet to be completed.  Council member Hortenstine moved to require Mr. Biggar to submit a bond, in the amount of $300,000, to the City to cover all outstanding punchlist items, as well as all off-site (storm drainage and wastewater line relocations) improvements; the City will also contribute an additional $20,000 towards the completion of the off-site improvements (specifically the wastewater line relocation aspect of the project) and agrees to record the plat with only ten (10) lots approved for permitting and with all improvements to be completed within 120 days of final plat approval.  Council member Jez seconded the motion.  VOTE:  Four voted AYE.  Motion passed.
